B. The name of the business that will appear on your bank/credit card statements will be Dart River Jet. Your account will be charged in New Zealand Dollars.
C. We advise that all activities carry a degree of risk and that by participating in the activity provided by the Operator you are expressly assuming those risks personally and are, to the maximum extent permitted by law, releasing the Operator and its officers and employees from any liability, claims, losses, damages or expenses caused by any event including, but not limited to:
• Personal injury or death
• Property loss of damage
• Acts which may be construed as negligent or accidental
• Any other loss, damage, suffering, emotional or nervous disorder.
1. In participating in the activity, I the passenger agree to the conditions set out as above and consent to the conditions in clauses 1(a) to 1(f) and 2 through 8.
a. I agree that my successors, executors, administrators and next of kin are bound by these terms and conditions.
b. I agree not to commence any litigation or proceedings in any country in relation to the risks and perils set out in B above and to indemnify the operator against any such claims.
c. I confirm that I am physically fit and suffer no medical conditions, which may be aggravated by this activity.
d. I consent to receive medical treatment in the case of injury, accident or illness during the activity and to indemnify the Operator against any claims in respect of this treatment.
e. I agree than any films, sound, video or other recordings taken of or during the activity will not be used in any promotion or advertising without the prior consent of the Operator, however the Operator may use such recordings itself at its complete discretion without any prior approval.
f. I agree to listen to my driver/guide, follow their instructions and make sure any children in my care do the same.
2. The selling agent and or Operator accept no responsibility for any loss or additional expenses arising from changes, delays or cancellations of the services and activities of the operator.
3. Cancellations by the Operator – The Operator reserves the absolute right to cancel any service as a result of weather conditions, insufficient reservations or any other unforeseen event or circumstance.
4. Cancellation or modification by the customer.
a. Up until 24 hours prior to the date and time of pre-paid travel the customer may change or even totally cancel the booking. These changes should be made directly with the Operator.
b. Within 24 hours any modification to the booking is at the absolute discretion of the Operator and may incur a fee up to a maximum of 100% of the price paid for the activity or service.
c. In the event that a pre-paid reservation is not utilized by the customer without any notification to the Operator no reimbursement will be given.
5. Refunds – the Operator reserves the right to assess cancelations on a case-by-case basis and any decision on refunds is entirely at the discretion of the Operator.
6. Any decision regarding an exception to the stated policy will be made entirely at the discretion of the Operator.
The laws of New Zealand apply to these terms and conditions and the delivery of the product. The Courts of New Zealand have exclusive jurisdiction to settle any claim arising from these terms and conditions or the delivery of the product
Prize description (“the Prize”):
The Prize is a refund of the individual pass retail rate paid by one passenger from the entrant’s Dart River Adventures trip.
1. By participating in the promotion, entrants agree to be bound by these terms and conditions.
2. The Promoter is Dart River Adventures, through its website www.dartriver.co.nz (“the Promoter”).
3. The promotion is open for entry 1st December 2024 – 31st May 2025 . Entrants must have been on a trip with Dart River Adventures from 1st December 2024 – 31st May 2025.
4. To be included as an entrant, entrants must:
a) publish a Google review for Dart River Adventures https://g.page/r/Cdh4ZbTLhQROEAE/review
OR
b) On Social Media Platforms mention/tag @DartRiverAdventures, platforms include but not limited to Facebook, Instagram and TikTok. On RED and WeChat platforms mention and tag @新西兰旅游Ngai Tahu
5. The Prize will be refunded to the credit card used at the time of purchasing the individual pass.
a)Where cash or debit card was used to purchase an individual pass, the Prize winner must provide their nominated New Zealand bank account details for the refund to be transferred to their account. If the Prize winner cannot provide a New Zealand bank account, a credit card will be required to issue the refund. No cash refunds will be provided.
6. The maximum total refund will be $349 for an individual Wilderness Jet Experience, or $495 for an individual Funyaks Experience.
7. To be eligible to win entrants must have booked directly through Dart River Adventures and not a third-party agent.
8. Visitors who used a free of charge or complimentary pass are not eligible to enter this promotion.
9. Employees of Te Rūnanga o Ngāi Tahu Group and their immediate families or related entities are not eligible to enter this promotion.
10. The Promoter reserves the right to amend, suspend or terminate this promotion and/or these terms and conditions at any time for any reason, or without notice.
11. The Promoter will not be liable in any way in relation to any loss, damage, harm, including personal injury arising in connection with this promotion. Any decisions made by the Promoter in relation to this promotion are final and no correspondence will be entered into.
12. The Prize is non-transferable.
13. All entrants must be aged 18 years or older.
14. Entries are the property of the Promoter and may be used for promotional purposes by them.
15. The winner will be notified via social media or Google. If the winner has not confirmed acceptance of their Prize within three days, the Prize will be redrawn.
16. The Prize does not include any other facilities or activities that are not listed in the prize description.
